These Terms of Service (“terms”) are an agreement between you and Muse Consulting Pty Ltd (ABN 32 133 856 907), trading as Bigger Better Brains (“Bigger Better Brains”, “we”, “us”), about your use of the BBB Daily Bite mobile app (the “app”). By creating an account or using the app, you agree to these terms. If you do not agree, please do not use the app.

1. Who can use the app

The app is made for teachers and other adult educators. You must be at least 18 years old to create an account and use it.

2. Your account

You are responsible for the information you give us when you sign up, and for keeping your password secure. You are responsible for activity that happens under your account. Please contact us if you think someone else has accessed it.

3. What the app provides

BBB Daily Bite gives you a daily, research-informed “Bite” about music, learning, and the brain, matched to the topics you choose. It also lets you set a daily reminder and save Bites to read again. We may add, change, or remove features over time.

4. Our content and how you may use it

The Bites, research summaries, text, and design in the app are owned by Bigger Better Brains or used by us with permission. We give you a personal, non-exclusive, non-transferable licence to use the Bites in your own teaching, for example when planning or discussing your classes.

You may not copy, resell, republish, or distribute the content at scale, or present it as your own, without our written permission.

5. The nature of the content

Each Bite is a short summary of research, written at a stated level of evidence, from established findings to emerging or early ideas. Bites are general educational information. They are not professional, medical, or psychological advice, and they are not a promise of any particular result in your classroom. Where a Bite links to outside research, that link is provided for your convenience, and we are not responsible for content on other websites.

6. BBB+ membership and payments

Some features may require a paid BBB+ membership. If you buy a membership, the purchase is handled through the Apple App Store or Google Play, and their billing and refund terms apply. Paid memberships may renew automatically until you cancel them. You can manage or cancel a membership in your App Store or Google Play account settings. If a feature that you have paid for changes materially, we will act fairly and in line with the Australian Consumer Law.

7. Acceptable use

When using the app, you agree not to:

•     Use it for any unlawful purpose, or in a way that harms others.

•     Try to gain unauthorised access to the app, its systems, or other users’ accounts.

•     Copy, reverse engineer, or attempt to extract the app’s content or source, except where the law allows.

•     Interfere with the normal running of the app.

8. Third-party services

The app relies on services provided by others, including Google Firebase and the Apple App Store or Google Play. Your use of those services is also subject to their own terms.

9. Availability

We work to keep the app available and reliable, but we cannot promise it will always be available or free of faults. We may update, suspend, or discontinue parts of the app, and we may update its content, from time to time.

10. Disclaimers and your consumer rights

The app is provided “as is”. To the extent permitted by law, we exclude implied warranties. Nothing in these terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law that cannot be excluded. Where our liability can be limited by law, it is limited to resupplying the service or paying the cost of having it resupplied.

11. Suspension and ending your use

You can stop using the app and delete your account at any time from the Settings screen. We may suspend or end your access if you seriously or repeatedly breach these terms.

12. Changes to these terms

We may update these terms from time to time. When we make an important change, we will update the date at the top and, where appropriate, let you know within the app. If you keep using the app after a change, you accept the updated terms.

13. Governing law

These terms are governed by the laws of the Australian Capital Territory , Australia, and you and we submit to the courts of that place.
